The growth of legal psychology in general, and of its applied branch, forensic psychology, is a well-established reality in Spain. The underlying reason is clear: psychology and the law converge in sharing the same object of intervention, human behaviour.

Specifically, the work of forensic psychologists is geared essentially to the practical, applied side of legal psychology.

Legal and forensic psychology covers the study, explanation, promotion, assessment, prevention and, where appropriate, advice on and treatment of the psychological, behavioural and relational phenomena that affect people's behaviour before the law, using the methods of psychology.

It has several areas of study and intervention, including:

Forensic psychologists and expert evidence

When legal psychologists take part in court proceedings in which their professional services have been requested as experts in psychological matters, they are regarded as expert witnesses.

The Spanish word perito comes from the Latin peritus, "a person who is learned, skilled or expert in a science or art".

As provided by the Spanish Civil Procedure Act, forensic psychologists (expert witnesses) must deliver their opinion in writing. This written opinion is the expert psychological report.

Expert psychological reports are a detailed written summary (which may also be presented orally) of the whole process followed to carry out a psychological assessment, covering:

  • The definition of specific objectives.
  • The psychological areas relevant to clarifying those objectives.
  • The methodology used to analyse those areas.
  • The results obtained and their significance.
  • The final conclusions reached after reviewing the whole process.
